Terms of Service

The terms governing your use of digited.net and the content we publish.

1. About these Terms

These Terms of Service ("Terms") govern your access to and use of the website digited.net (the "Site") and the content we publish through it: the research and writing, the informational pages, and, in future, a newsletter. These Terms do not govern a paid engagement, which is set out separately for the relevant part of the ecosystem.

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who we are

The Site is owned and operated by Claire AM Guillon, trading as Digited Atelier, operated as a sole proprietorship, working online. In these Terms, "we", "us", and "our" refer to Digited Atelier. Our contact details are in Section 12.

3. Your use of the Site

You may access, read, and share the content on the Site for personal, non-commercial use, subject to the intellectual property terms in Section 4. You agree not to:

4. Intellectual property

All content on the Site (the texts, the essays and research, the illustrations, the designs, and the Digited Atelier brand elements) is owned by us or licensed to us. You have a personal, non-commercial licence to access and read it. Beyond that licence, all rights are reserved.

You may quote short extracts (up to 300 words) with attribution for non-commercial purposes; link to the pages; and cite the Site in academic or educational materials with full attribution. You may not republish a work in full or in substantial part, produce a derivative product for commercial distribution, use the Digited Atelier name or marks on your own materials without written permission, or use the content to train a machine-learning model without our written permission. Published academic papers remain governed by the terms of their respective publishers.

If you submit content to us (a message, a response to a form), you grant us a non-exclusive, royalty-free licence to use it for the purpose for which you submitted it. You retain ownership of what you submit. We anonymise or omit identifying details when quoting from submissions in public writing, unless you give explicit written consent to be identified.

5. Third-party links and services

The Site links to other sites in the Digited Atelier ecosystem and to third-party services, and it relies on service providers, for example our hosting, enquiry forms, and newsletter. We do not control third-party sites and are not responsible for their content or practices. Your use of any third-party site is governed by that site's own terms and privacy policy.

6. Disclaimers

The Site and its content are provided "as is". The research and writing are offered for information and scholarly exchange; they do not constitute legal, financial, or medical advice. We do not guarantee that the Site will be available without interruption or that the content will always be current.

7. Limitation of liability

To the extent permitted by applicable law, and excluding liability that cannot be limited by law (such as liability for death or personal injury caused by negligence, or for fraud): our liability for any claim arising out of or relating to the Site or its content is limited to the amount you have paid us in the twelve months preceding the claim, if any; we are not liable for indirect, consequential, or incidental loss; and nothing in this Section limits your statutory rights as a consumer.

8. Termination

We may suspend or terminate your access to the Site if you breach these Terms. On termination, the disclaimers, the limits of liability, the intellectual property terms, and the dispute terms continue to apply.

9. Changes to these Terms

We may update these Terms from time to time. The current version and its effective date are shown at the foot of this page. Where a change is significant, we will take reasonable steps to bring it to your attention. Continued use of the Site after a change takes effect indicates your acceptance of the revised Terms.

10. Governing law and disputes

These Terms are governed by French law, reflecting the French hosting of this site and the online, cross-border nature of the practice. Nothing in this Section limits any mandatory consumer-law rights you have in your country of residence.

11. The relationship to our other policies

These Terms work together with our Privacy Policy and our Code of Conduct.

12. Contact

For any question about these Terms, please write to contact [at] digited [dot] net. This Site is owned and operated by Claire AM Guillon, trading as Digited Atelier, working online.
